Guidance Document

I. INTRODUCTION

I.1 Purpose: The Purpose of this document is to reaffirm the items set forth in the Declaration of Covenants, Conditions, and Restrictions which are binding on all parties having any right, title, or interest in properties in the Ascot subdivision; and to reacquaint property owners and residents with certain particularly relevant sections of the Fairfax County Zoning Ordinance (as currently amended).

I.2 Authority: Authority for interpretation and enforcement of these standards rest with the Ascot Homeowners Association, Inc, hereinafter referred as the 'Association' and with the Association's Architectural Review Committee, hereinafter referred as the 'Committee', as set forth in the above-mentioned Declaration of Covenants, Conditions, and Restrictions, hereinafter referred to as the 'Covenants'.

The covenants and the Fairfax County Zoning Ordinance (as currently amended); hereinafter referred to as 'County Ordinance,' are implicitly made a part of this document and shall supercede this document when and if any conflicts exist.

I.3 Approval: Plans and specs are to be submitted to the Architectural Review Committee a minimum of 30 days prior to construction. It is recommended that submittals to the committee include a statement on whether or not planned improvements have been discussed with neighbors, and identifying any concerns raised.

II. GUIDANCE

Guidance is provided for specific elements for the purpose of protecting the value and desirability of the real estate property, and ensuring the architectural harmony of the community.

Due to the configuration of lots in the community, impact on one's neighbors is considered an exceptionally sensitive issue by the Architectural Review Committee.

III. SPECIFIC ELEMENTS

III.1 Freestanding Structures

a. Purpose: To reaffirm conditions set forth in the covenants requiring approval of plans and specifications by the committee prior to construction.

b. Scope: This section includes pools, sheds, garages, stables, barns, animal enclosures, walls, fences, and others.

c. Standard: Design and location of freestanding structures shall be harmonious with surrounding structures and topography.

III.2 Fences/Walls

a. Purpose: To reaffirm conditions set forth in the covenants requiring approval of plans and specifications by the committee prior to construction.

b. Scope: This section includes fences and walls, be they freestanding or attached to an existing structure located on the property.

c. Standards:

  • All fences/walls located within the front yard of a property and visible from the roadway shall be limited to 4 feet in height and not resemble nor be a 'privacy style' fence. Split rail fences and board fences are types generally considered appropriate.
  • Fencing in the side yards and rear of the house shall be left to the homeowners discretion except in the following instances: no fencing shall exceed 7 feet, no fencing shall be installed which would infringe on adjacent homeowner's right to natural elements: i.e., sun, shade, and view.
  • Fences/walls shall be maintained in a manner deemed appropriate by the Committee and the County.
  • Fencing or Walls erected should be of an aesthetically pleasing nature; one which enhances the natural environment rather than competes with it.

III.3 Attachments/Appurtenances

a. Purpose: To reaffirm conditions set forth in the covenants requiring approval of plans and specifications by the Committee prior to construction and to provide general guidance on certain elements.

b. Scope: This section includes such attachments and appurtenances as: decks, additions, windows grates, antennae, prefab fireplaces, and others.

c. Standards:

  • All decks, additions, and other structures attached to the original dwelling shall be in conformance with County building code.
  • All decks and additions shall be of such a nature as to enhance the property and be in harmony with the surrounding structures.
  • The architectural style, color, and lighting of such decks and additions shall be of such a nature as to adapt to the existing structure and its environment.
  • Items such as window grates, and other exterior treatments attached to the existing dwelling shall conform to the style and trend established by the Developer.
  • Pre-fab fireplaces installed after the existing structure has been erected must be in compliance with the County's BOCA Code. All pre-fab fireplaces will have a finished appearance that is architecturally compatible with the existing structure. Those fireplace units which must have a chimney clearance of more than 3 feet above the existing roof structure as to be in compliance with the BOCA Code must be approved by the Committee prior to their erection. Fireplace flue lining attached to the side of the house shall be finished in such a manner as to conform to the existing structure (i.e., placement of fireblocking and finished painted siding).
  • Outdoor antennae and satellite dishes larger than the size of one-meter in diameter expressly permitted by Federal law are considered undesirable by the Committee.
